Terms & Conditions of Sales
1 Preamble:
The Riad La Porte du Bouregreg is operated by the company Ô Saveurs de la Médina , a Moroccan SARL with capital of 20,000 DHS, having its registered office at 6 rue Abdellah Bensaid, Salé Morocco, registered in the Moroccan Trade and Companies Register under number 28117.
The company Ô Saveurs de la Médina offers its customers the opportunity to book its hotel rooms and associated services on its website www.riadlaportedubouregreg.com (hereinafter the ""Site""), by email at contact_riad@osaveurs-medina.com, by telephone at +212 611 34 35 50 or via various reservation websites (e.g. booking.com). Seminar rooms can only be booked by telephone, post or email. These general terms and conditions of sale for Riad La Porte du Bouregreg (hereinafter the "GTC") define the rights and obligations of the parties in connection with the reservation of rooms within the Hotel and other services offered by the company Ô Saveurs de la Médina. Any reservation implies the Customer's acceptance without restriction or reservation of the GTC, either on the website at the time of reservation by checking the box provided for this purpose, or on paper at the time of check-in. The Customer declares to have obtained from the company Ô Saveurs de la Médina all the necessary information on the Site and to have full legal capacity allowing him to commit to the GTC. The Customer has the option of saving and editing the GTC from the Site using the standard functions of his browser or computer or to request a paper copy during Check-in. The Site mentions the following information:
The essential characteristics of the accommodation offered.
The additional services offered.
• Prices and payment terms.
The General Terms and Conditions.
2 Definitions:
In the remainder of this document, the terms below shall have the following meaning:
""Acknowledgment of receipt"" : Email sent by Riad La Porte du Bouregreg to the Client summarizing the reservation made by the Client and confirming its receipt.
""Booking Confirmation"" : A digital document that summarizes the characteristics of the services booked by the Customer, and through which the Customer enters their bank card number as part of a prepayment. The Customer's prepayment of a reservation has the effect of contractually binding the Customer and the company Ô Saveurs de la Médina.
""Client"": Natural or legal person acting for their personal or professional needs.
""Consumer"" : Any natural person who acts for purposes which do not fall within the scope of his commercial, industrial, craft or liberal activity.
""Electronic mail"" : Any message, in the form of text, voice, sound or image, sent over a public communications network, stored on a network server or in the recipient's terminal equipment, until the recipient retrieves it.
""Reservation Request"" : Request for reservation of hotel rooms made by the Client by any means.
""Partners"" : Providers of services accessible from the Site or Mobile Services, and in particular, airport shuttles and beauty care professionals
""Online Reservation"": Reservation of hotel rooms via the electronic reservation system on the Site.
""Service"" : Reservation of hotel rooms whose characteristics are presented on the Site as well as the associated services.
""Site"" : Electronic service operated by the company Ô Saveurs de la Médina on the Internet and accessible at the address www.riadlaportedubouregreg.com
3 Reservations:
The Customer acknowledges having read the nature, destination and booking terms of the services available on the Site and having requested and obtained the necessary and/or additional information to make their booking with full knowledge of the facts.
The Customer may book, on the Site, individually and for his personal needs, an unlimited number of rooms, the only limit being the maximum number of beds. For reservations concerning business or tourist groups, meetings, seminars, etc., it is necessary to contact us by telephone or email.
The Client is solely responsible for his choice of services and their suitability to his needs, such that the liability of the company Ô Saveurs de la Médina cannot be sought in this regard.
The reservation is deemed to have been made upon confirmation by the company Ô Saveurs de la Médina or upon online prepayment by credit card or upon actual payment of the deposit for group reservations. (see article 4.)
The Customer undertakes, prior to any reservation, to complete the information requested on the voucher or during the reservation request. He also undertakes, where applicable, to communicate the number of any Promo Code that he intends to use to pay for all or part of the reserved stay.
The Riad la Porte du Bouregreg website acknowledges receipt of the Client's reservation following payment by credit card, by sending an email without delay.
In the case of online booking, the acknowledgment of receipt of the booking by email summarizes the services booked, the prices, the sales conditions relating to the selected rate accepted by the Customer, and the date of the booking made.
4 Validation by prepayment:
Except in specific group cases, all reservations are subject to prepayment of the full amount of the reservation.
This prepayment has the effect of validating the reservation and contractually committing the Customer and the company Ô Saveurs de la Médina with regard to these General Conditions of Sale.
Other bookings – Group bookings of more than 10 people are only accepted upon payment of a deposit of 30% of the total cost of the stay.
All prepayments (deposit or full amount) can be made:
Either by direct debit from bank card: VISA, MASTERCARD, AMEX via the Site
Either by bank transfer
Either by Paypal type transfer
5 Cancellation or modification by the Customer
Except in specific cases (force majeure, etc.) negotiated between the Client and the Management of the riad la Porte du Bouregreg, all reservations cancelled by the Client will be processed according to the following terms:
Cancellation conditions for group and other bookings: (D = day of arrival)
Cancellation D – 30 and more: refund of 90% of the prepayment
Cancellation between D-29 and D-7: reimbursement of 50% of the prepayment
Cancellation between D – 7 and D: no refund of prepayment
No show at the hotel (No Show): no refund of prepayment
Where possible, all cancellations must be confirmed by mail, fax or email.
For any shortened stay or delayed arrival, the full cost of the stay planned in accordance with the reservation will be due.
6 Stay at the Hotel
All reservations are personal and cannot under any circumstances be transferred to a third party, whether free of charge or for a fee.
The maximum number of people per room is two (2) for a Standard room and four (4) for a Suite. It is possible to add a baby cot at a rate of 50 DHS per night for children up to 3 years old.
Rooms are available from 3 p.m. on the day of arrival and must be vacated by 12 p.m. on the day of departure, regardless of the time of arrival or departure, or the means of transport used, unless expressly stated otherwise. Otherwise, an additional night may be charged. Depending on availability, the room may be kept until 3 p.m. on the day of departure for a supplement of 20 euros.
In accordance with Moroccan law, the Client will be asked to complete a police form upon arrival at the Hotel. To do this, you will be asked to provide proof of identity. Ô Saveurs de la Médina will keep a copy of your proof of identity.
Animals are not normally accepted in the Hotel except in very specific cases. The Customer wishing to bring an animal into the Hotel during their stay must notify us at least 2 days before their arrival to inform us of this wish and provide us with details about the animal. The Customer must present a vaccination certificate for their animal upon arrival. In any case, Ô Saveurs de la Médina reserves the right to refuse an animal that it considers dangerous or whose behavior is likely to disturb the peace and comfort of the Hotel's Customers.
Price: 50 DHS per night and per animal.
The Client accepts and undertakes to use the room with due care. Also, any behavior contrary to good morals and public order will lead the company Ô Saveurs de la Médina to ask the Customer to leave the establishment without any refund if a payment has already been made. In the event that no payment has yet been made, the Customer must pay the price of the nights consumed before leaving the establishment.
The Hotel offers free Wi-Fi access allowing Guests to connect to the Internet. The Guest undertakes that the IT resources made available to them by the Hotel will not be used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of Intellectual Property when this authorization is required. If the Customer fails to comply with the aforementioned obligations, he/she may be charged with an offense of counterfeiting punishable by a fine of 300,000 DHS and three years of imprisonment. The Customer is also required to comply with the security policy of the Hotel's internet service provider, including the rules for using the security measures implemented to prevent the illicit use of IT resources and to refrain from any act that undermines the effectiveness of these measures.
The Hotel is accessible by car but does not have its own parking spaces. However, the Guest may park their vehicle on the Riad's street or in an adjacent street and hire the services of a "guard" who will monitor it for 20 DHS/night. These "guards" are easily spotted with their yellow vests and will find you a parking space. The Guest will pay the guard directly for the service provided.
Smoking is prohibited throughout the entire Riad La Porte du Bouregreg establishment, except on the rooftop terrace. On this same terrace, we ask that smoking guests respect non-smokers by asking their permission if they are seated nearby.
From 11 p.m., in order to respect everyone's sleep, we ask that noise pollution be stopped (televisions too loud in bedrooms, excessive singing and laughing in living rooms or on the roof terrace, etc.)
Any request for a room change more than one hour after check-in and key collection will be made under the following conditions:
A new room will be offered based on availability. This new room will be billed to the Customer at its normal price. A cleaning fee of 100 DHS will be charged to the Customer for the first room.
In the event that no other room is available, the Customer will have the choice of keeping their room or leaving the hotel. If the Customer chooses to leave the hotel, this will be considered a cancellation.
7 Prizes
Prices relating to the reservation of services are indicated before and during the reservation.
The prices indicated are per room and per night, for the number of people and dates selected according to the rates in effect during the period of stay.
Prices are confirmed to the Customer in Moroccan Dirham.
All reservations, regardless of their origin, are payable in Moroccan Dirham or euros.
Tourist tax and additional services (baby bed, half-board, full-board, Hammam, cooking classes, beauty treatments, etc.) if these are not included in the reservation and prepayment, must be paid directly on site to the hotel.
Prices include VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the prices shown on the invoice date.
Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the invoice date.
Ô Saveurs de la Médina will indicate the total amount of the booked stay upon confirmation of the Client's reservation. Services ordered and consumed during the stay will not be included; these will be payable on site.
Some promotional offers that may be available online are sold exclusively online and under no circumstances at the hotel reception.
8 Payment
In the event of a reservation via the Website www.riadlaportedubouregreg.com, the Customer will confirm their reservation via a secure online payment using their credit card for the full amount of their reservation. The amount to be paid in this case will depend on the type of rate chosen by the Customer, the room or suite selected, the period and length of stay and finally the number of days between the reservation date and the arrival date.
In the case of the initial payment of a deposit by the Client to secure their reservation (example: group of more than 10 people) they will be asked:
To pay a deposit of 50% of the total amount on the date of reservation
To pay the remaining balance for the services ordered no later than 7 days before the arrival date. Failure to receive the balance within this period may result in the release of the reserved rooms and non-refund of the deposit.
In the event of a reservation via a partner platform (e.g. Booking.com), the Customer will comply with the reservation and payment terms offered by the said platform. In the event that the Customer has not paid the partner platform directly at the time of reservation:
The Riad Management reserves the right to test the validity of the Client's credit card before arrival by making a charge that will not exceed 50% of the total amount of the reservation.
If this credit card turns out to be invalid, the riad management will cancel the reservation with the partner platform by informing the latter of the invalidity of the credit card.
If this credit card is valid, the Customer will be asked to pay the full amount or the remaining amount due for the services ordered upon arrival at the Hotel in cash or by credit card.
Any missing equipment (for example: bottle opener, towels, bath towel, bathrobe, etc.) will be invoiced to the Customer and debited according to the terms in the paragraph below.
The Client expressly and irrevocably authorizes the company Ô Saveurs de la Médina to debit the bank card whose details were communicated to it by the Client for the purpose of paying all sums due for the stay, including the cost of repairs and restoration of any damage, breakage, theft, etc. attributable to the Client and/or the persons accompanying him.
9 Responsibility
The photographs presented on the Site / Brochures / Displays are not contractual. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the hotels presented give as accurate an overview as possible of the accommodation services offered, variations may occur, in particular due to changes in furniture or possible renovations.
Hypertext links may lead to sites other than the Ô Saveurs de la Médina company site, which accepts no responsibility for the content of these sites and the services offered.
Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the Customer's expense, without prejudice to any civil or criminal action against the latter.
10 Respect for privacy.
The Customer is informed, on each of the online forms for collecting personal data, whether the responses are mandatory or optional by the presence of an asterisk. Optional requests for information are intended to better understand and improve the services offered to them.
If information is not identified as mandatory, the Company may not be able to record a reservation or manage the latter's complaints.
The information processed is intended for the company Ô Saveurs de la Médina, its partners, its service providers, and in particular online payment providers, to whom the Customer authorizes the communication of their personal data.
As part of pre-contractual measures for the reservation or execution of the reservation contract, they may, each as far as they are concerned, be recipients of identity data, personal and professional life data, economic and financial information, in particular for the purposes of hotel reservations and claims management, but for exclusively non-commercial purposes, which the Client declares to have read and accepted.
The Customer has the right to access, modify, rectify, and delete data concerning them. To exercise this right, simply contact Ô Saveurs de la Médina and submit a request to the postal and email addresses listed at the top of these General Terms and Conditions.
11 Evidence Agreement
The entry or submission of the required banking information, as well as the acceptance of these general conditions and the voucher or reservation request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
The computerized records stored in the computer systems of the company Ô Saveurs de la Médina will be kept under reasonable security conditions and considered as proof of communications, orders and payments between the parties.
The Customer is informed that his IP address is recorded at the time of booking.
12 Displacement
In the event of unavailability of the Hotel, technical problem in the Hotel, works or for any other reason, excluding cases of force majeure, the Hotel will make its best efforts to accommodate the Participants in whole or in part in another hotel for services of the same nature and quality.
Any additional cost for the room, transport between the two hotels and a telephone call will be borne by the company Ô Saveurs de la Médina, which cannot be sought for payment of any additional compensation.
13 Force majeure
Force majeure means any event external to the parties which is both unforeseeable and insurmountable and which prevents the company Ô Saveurs de la Médina from fulfilling all or part of the obligations provided for in the contract (examples: fire, flood, water damage, room trashed by the previous customer, etc.).
The company Ô Saveurs de la Médina cannot be held liable to the Customer in the event of non-performance of its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends, for the company Ô Saveurs de la Médina, the execution of its obligations and that each party bears the cost resulting therefrom.
14 Dispute Resolution
The Customer is informed by the company Ô Saveurs de la Médina of the possibility of resorting, in the event of a dispute relating to these general conditions, to a conventional mediation procedure or to any other alternative method of dispute resolution.
Complaints relating to the non-performance or poor performance of hotel services must, under penalty of foreclosure, be brought to the attention of the company Ô Saveurs de la Médina in writing within eight days after the date of departure from the hotel directly to the hotel or to the Customer Service contact details indicated at the top of these General Terms and Conditions.
After contacting customer service or the hotel and attempting to resolve the dispute amicably, if no amicable settlement is reached within 60 days from the date of contact, the customer may contact the Tourism and Travel Mediator.
15 Applicable law – Language – Competent court
These General Terms and Conditions of Sale are governed by Moroccan law. Only the French version of these General Terms and Conditions is legally binding. In the event of a persistent dispute, exclusive jurisdiction is given to the courts within the jurisdiction of the Rabat Court, including in summary proceedings.
16 Entirety
These General Terms and Conditions and the reservation form or request express the entirety of the parties' obligations.
No general or specific conditions communicated by the Client may be incorporated into these general conditions.
The documents forming the contractual commitments between the parties are, in decreasing order of priority, the reservation form or request (including the specific conditions of the reserved rate) and these General Terms and Conditions.
In the event of a contradiction between the booking form and the T&Cs, the provisions appearing on the booking form will be the only ones applicable to the obligation in question.
17 Evolution / modification of the General Conditions of Sale
These General Terms and Conditions may be amended and/or supplemented at any time by Ô Saveurs de la Médina. In this case, the new version of the General Terms and Conditions of Sale will be posted online by Ô Saveurs de la Médina. As soon as it is posted online, the new version of the General Terms and Conditions will automatically apply to all Customers.
